GENERAL CONDITIONS FOR BOATS WITH LICENSE

LICENSE. The boat should be rented by the person designated in this contract which has to hold the appropriate boat license.

PROHIBITIONS. Sail more than one mile away from the coast is prohibited. (1.8 km), also exceed the maximum number of people on board according to the capacity of each boat. Beach the boat or access to the beach. Enter, stay or leave the water with the engine on and also leave the boat moored or anchored without anyone on board.

RESPONSIBILITIES. Maximum speed inside the port and near beaches is 3 knots. You must respect the bathing areas and drop the anchor outside the yellow buoy line on the beaches. The minimum distance from the beach and cliffs is 200 m. A distance of 100 m. must be kept from boats and buoys with diving flags. During navigation it is recommended to use the provided life jackets and to be seated in the respective seats of the boat. The lessee assumes all responsibility for any fine, penalty, harm or damage caused or derived from the violation of any clause of this contract and/or for any violation of current Spanish and international laws. Improper use of the boat will entitle any person authorized by the company to the termination of the rental without any right to a refund of the paid amount to the lessee. It is very important that the skipper and/or crew always have a telephone available to contact us or so that the Blanes Boats team can call to inform of any unforeseen event that may arise.

CHECK IN / CHECK OUT. The boat will be delivered and returned to the base port in Blanes. It will be returned with all its equipment in the same conditions in which it was delivered and on the date and time stipulated in the contract. If check-out takes place later than the stipulated time (without noticing), an amount of €150 will be charged for every 30 minutes of delay or its proportional part. If the boat is returned before the scheduled delivery time, no type of refund will be made.

FUEL. Fuel is not included in the rental price. The boat will be delivered with a full tank and will be returned full. The lessee should refuel the consumed amount at the gas station.

INSURANCE. Rentals are covered by a third party insurance. They also have physical coverage for the crew. The client must leave a deposit of €500.00 to respond to any damage, loss of material or delay in the return of the boat. However, if the amount resulting from the aforementioned incidents is more than the deposit, the client is obliged to pay the difference. Blanes Boats offers a comprehensive insurance with a deductible of €300.00 that covers personal and material damage to the boat. Insurance will not cover damage caused by negligences. The price of this insurance is €35. Activities that involve towing devices such as bananas, inflatables, skis, etc. are excluded from insurance coverage. The lessee will be responsible for their use and the consequences that may arise from it. The company is not responsible of personal belongings that are left forgotten, damaged or lost. The lessee takes on in all the risks and exempts the business from any claim that can be brought about by them.

NAVIGATION AREA. Blanes Boats recommends not surpassing Sant Feliu Port, because in case of bad weather or sudden climatology change it can cause problems. If you decide to pass anyway, Blanes Boats reminds you that if you need to tow the boat due to damage or lack of fuel, Blanes Boats will not be responsible and the insurance will not cover the loss of belongings and the personal damage. In case of towing the boat for any circumstance, the company will be exempted from responsibility and €1.000 will be changed to carry out the rescue. Also a warranty of immediate service will not be insured.

BREKADOWN. In the event of a breakdown, collision or loss of material, the lessee must immediately notify Blanes Boats, who will inform him of the instructions to follow. If during the rental a very serious fault occurs, not attributable to the lessee, which does not allow the rental to continue, Blanes Boats will reimburse the contracting party for the hours not used or will deliver a vessel with similar characteristics to the one contracted. Said choice will be exclusively at the discretion of Blanes Boats, without any other responsibility. In the event that the breakdown or accident is attributable to the responsibility of the contracting party, the latter must pay the costs of towing and the necessary repairs to keep the boat, engine or accessories in the state in which they were delivered by the company at the beginning. of the rental contract, being only Blanes Boats authorized to carry out said repairs, not taking charge of any repair not carried out by its personnel.

LEGISLATION. For any controversy that may arise from the content or interpretation of this document, both parties, expressly renouncing their own jurisdiction or that to which they could access, commit themselves by mutual agreement to the judges and courts of Blanes and corresponding superior hierarchies. These General Rental Conditions are written also in Spanish, the only applicable language and this translation is only informative.

LICENSE. The boat should be rented by the person designated in this contract, who must be over 18 years old.

PROHIBITIONS. Staying more than one mile away from the coast (1.8 km) is prohibited, ALSO EXCEED the maximum number of people on board according to the capacity of each boat. It is forbidden to make sudden and continuous "donut" turns with the boat. In case of non-compliance, it may be a reason for ending the trip without the right to a refund of the rental amount. If the boat is damaged, it will imply the total loss of the deposit.

It will be returned with all its equipment in the same conditions in which it was delivered and on the date and time stipulated in the contract. If check-out takes place later than the stipulated time (without noticing), an amount of €100 will be charged for every 30 minutes of delay or its proportional part. If the boat is returned before the scheduled delivery time, no type of refund will be made.

FUEL. The boats have a full gasoline tank of 25 liters included in the rental price

INSURANCE. Rentals are covered by a third party insurance. They also have physical coverage for the crew. The client must leave a deposit of €250.00 (VORAZ 500) or 150€ (VORAZ 450) to respond to any damage, loss of material or delay in the return of the boat. However, if the amount resulting from the aforementioned incidents is more than the deposit, the client is obliged to pay the difference. Blanes Boats offers a comprehensive insurance of 125€ (Voraz 500) or 90€ (Voraz 450) that covers personal and material damage to the boat. Insurance will not cover damage caused by negligences. The price for this insurance is 20€ for half day rentals and 35€ for full day rentals. The enterprise is not responsible of personal belongings that are left forgotten, damaged or lost. The lessee takes on in all the risks and exempts the business from any claim that can be brought about by them.

NAVIGATION AREA. The boats have a restricted navigation zone that goes from the Tordera River at south to the Lloret de Mar Castle at north. Those limits are marked in the maps that you’ll find in all of our boats. Blanes Boats reminds you that exceeding the limits marked on the map you will be sanctioned with 200€. Also when exceeding the limits any kind of assistance you may need will not be covered by the insurance and Blanes Boats will not be responsible for any damages, towing costs, losses, etc. In case of towing the boat for any circumstance €200 will be changed to carry out the rescue and a warranty of immediate service will not be insured. In case of assistance towing due to any neglicence the rescue and towing have a 500€ cost if you’re out of the limits.
